American Federation of Musicians - Reno Local No. 368

A musicians' union has existed in Reno since 1909. The American Federation of Musicians (AFM), Reno Local No. 368, was chartered January 1, 1917 as the Reno Musicians' Protective Union Local No. 368. The Union formally incorporated in Nevada on June 30, 1950 as the Reno Musicians' Union. The Union has also been known as the Reno Musicians' Protective Union Local No. 368 and the Reno Musicians Association; all of these names were used throughout the records. Local 368's jurisdiction includes Reno, Sparks, Carson City, and Lake Tahoe.

The purpose of forming a union was to unite musicians of Reno and the vicinity for better protection of their interests, to regulate wages and all business connected with the musical profession, and to enforce good faith and fair dealing between its members. Membership was open to all instrumental performers who had been residents of the area for at least 30 days (later changed to 90 days) and who were approved by the Board of Directors. Honorary membership could be awarded to eminent composers or instrumentalists, or any other non-professional who had distinguished himself to the benefit of the Union or musical profession.

The Union was under the leadership of its officers: president, vice-president, secretary, treasurer (later combined into the secretary-treasurer), three trustees, an eight-member Board of Directors, and a sergeant at arms. Based on information found in the collection it appears that the secretary-treasurer was a full-time position and carried out the everyday activities of the Union.

Prior to 1950, the Union met at the Labor Temple at 440 N. Virginia Street. Union members voted in June of 1950 to buy the buildings and property at 120 W. Taylor Street. The current union hall was built in 1962-63 at 124 W. Taylor St. Over the years the building was shared by the Musicians Union, the Reno Musicians Federal Credit Union, and presently, the Hotel Employees and Restaurant Employees Union Local 86.

Union members twice organized a credit union for members; the first was prior to 1964; the second existed from 1964-1973. A more complete history of the Credit Union can be found in the section of this guide which describes Series 5, Reno Musicians' Federal Credit Union.

Throughout its history, the Union has taken very seriously its constitutional charge of securing and providing for improved wages, hours, working conditions, and other economic advantages. It has been able to do so through its organization, rules, regulations, negotiations, binding arbitration, collective bargaining, and threat of strike.

Scope and Content

The records of the AFM, Reno Local No. 368 were donated to the Special Collections Department in 1991 by Local 368. The collection dates from 1909-1910 and 1930-1984 and has a volume of 42 cubic feet. There are no restrictions on access to these records.

The collection is relatively complete for the period 1960-1984, and well represented from a financial aspect for the years 1930-1960. All activities of the Union can be documented through the minutes, alphabetical files, stewards' reports, grievances, and collective bargaining series. Not only do these records chronicle one facet of organized labor in Reno but they also pull together in one location, documentation about the entertainment industry in Reno, particularly in casinos, through the stewards' reports and collective bargaining series.

The arrangement of this collection follows the original order as created by the Union. One of the largest series, the Alphabetical Files, contains both correspondence and subject files which would normally be divided into separate series. Correspondence is located in several sections within the alphabetical files; some may be found under "Correspondence" and some under the name of the sender, such as "AFM-Correspondence" or "President's Files-Correspondence." The content of the correspondence files is both local and national in scope, as the Local often referred issues and conflicts to the parent body for resolution or clarification. Other correspondence between the Local and individual members deals with day to day operations, rules, regulations, and other details of Union membership.

These papers provide evidence of the evolution of casinos in Reno and in particular, the type of entertainment they offered to visitors. In general, the trend was a change from many casinos offering their visitors "big name" entertainment, to only a few operating such venues. This change in the entertainment industry had repercussions on the local economy, professional musicians, and the Musicians' Union as well. Casinos with showrooms hired "house bands" to provide the accompaniment for their headliners; as showrooms closed and casinos economized, fewer positions were available to union members and less income accrued to the Union from work dues.

One of the most important topics featured in this collection is that of the role of trade unions in Reno. The labor movement in Reno has a spotty history; strong in the years prior to the Great Depression of the 1930s and weaker since then. Nevada's status as a "right to work" state complicates the Union's goal to make the Reno entertainment industry a "union shop." Collective bargaining issues in this collection clearly illustrate those goals, as the casino industry tried numerous times to weaken the Union by refusing to bargain collectively, or by asserting that the Union could not legally represent musicians. Both the Alpha Files and Collective Bargaining Series provide illustrations for these trends.

The minutes of regular and special meetings of the Board of Directors and Annual Membership Meetings derive from the Reno Musicians' Protective Union Local No. 368, Reno Musicians' Union No. 368, and the Reno Musicians' Association. The minutes provide names of board members and officers present at meetings, reports of business conducted, and names of new members or members suspended. Issues discussed included changes to bylaws, relations with the Central Trades and Labor Council, events in Reno involving musicians, the state of "live music" in Reno/Sparks, resolutions, financial matters, benefit performances, decisions of the Board sitting as a hearing board, and special projects. The minutes are arranged chronologically.

This series consists of subject files which include correspondence; constitutions and bylaws; and files about specific individuals, issues, and events. They include materials sent to or received from the parent union, the American Federation of Musicians, concerning business affairs with Local 368. Subjects covered include legal issues; death benefits; agreements for performances on radio, television, and film; the Law and Legislation Committee; the National Association of Orchestra Leaders; National Labor Relations Board (NLRB); Nevada State Labor Commissioner; local hotels and casinos; and wage scales. In several instances files which were found in other series were intermingled with the Alpha Files; for example, NLRB case files are similar to those in Series 4, "Grievances," and Alpha Files listed under names of individual hotels are often negotiation documents like those found in Series 3, "Collective Bargaining Agreements." The Alpha Files are arranged alphabetically and chronologically within each category.

Series 3. Collective Bargaining Agreements. 1968-1982. 2.5 cu. ft.

A major role of the Reno Musicians' Union was to negotiate and establish basic wages of professional musicians in the Reno area, establish working conditions such as length of working day and week, procedures for filing grievances, and conditions for recording performances; and designate who was considered employer and employee for casino showroom purposes. To that end, the Union classified all Reno area venues according to certain physical characteristics such as size and facilities available; minimum wages reflected those classifications. The Union also established conditions and wage scales for events such as weddings, benefits, jam sessions, and church services.

The largest hotels and casinos were covered by collective bargaining agreements: they included the Cal-Neva Lodge, Crystal Bay Club, El Dorado Hotel, Harolds Club, Harrah's (Reno and Tahoe), Harvey's Resort Hotel, Holiday Hotel, Holiday Inn, Hyatt Lake Tahoe, Mapes Hotel, Money Tree, Nevada Lodge, North Shore Club, Ponderosa Hotel, Riverside Hotel, Sahara Tahoe Hotel, and Sparks Nugget.

Several times, acting just prior to the expiration of an existing three year agreement, the above establishments attempted to break the hold of the Union in dictating wages and work conditions. Strikes ensued, such as the one in early 1968. Although decisions favorable to the Union were handed down by the National Labor Relations Board, in that year the strike was particularly painful for members, leading in part to severe financial difficulties for the budding Reno Musicians' Federal Credit Union.

This series, and files in Series 2, Alpha Files, reveal much about the process of negotiation/strike/settlement. Records in Series 3 consist of negotiation notices which were sent to individual businesses employing professional musicians; notes on negotiations between Local 368 and resorts and casinos in Reno; correspondence between the Union and employees; and bargaining agreements signed by employers. Series 4. Grievances. 1962-1979. 1.5 cu. ft.

Grievances are a method or procedure for filing a legal protest or claim. Grievances could be filed by the Union against an employer or union member, or by a member against an employer or other union member. Typical grounds for grievances included failure to pay wages, improper termination of employment, failure to pay union dues, performing with non-Union musicians, crossing a musician's picket line to perform, and failure to file a contract.

Local grievances were filed in writing and then arbitrated by one representative each of the Union and the employer. Failure to reach an agreement sent the grievance to a hearing by a local Board of Adjustment, which was composed of two representatives each of the Union and Employer. The Board's decision was final; however, if the Board failed to reach an agreement the matter could be submitted to arbitration upon written request of either party. A single Impartial Arbitrator was selected by both parties or appointed by the American Arbitration Association. The Arbitrator's decision was final.

Grievances which were not settled locally were sometimes adjudicated by the International Executive Board of the American Federation of Musicians of the United States and Canada. Failure to comply with the Board's decision resulted in the defaulting party's name being placed on the National Defaulters' List of the A.F.M.; union members were then prohibited from conducting business with the listees.

This series contains correspondence; grievance claims, evidence, and rebuttals; and Board decisions on grievance cases. Grievance cases are arranged chronologically by date of hearing and in alpha/numeric order by case number. Cases lacking a file number were placed at the end of the appropriate year.

Series 5. Reno Musicians' Federal Credit Union. 1963-1973. 1 cu. ft.

The Reno Musicians' Federal Credit Union (RMFCU or CU) was organized in January 1964 and received its charter May 21, 1964. It followed an earlier credit union for the Musicians' Union. At its peak the CU which began in 1964 had 323 members out of a potential of 450-600 Union members eligible to join.

The CU was located at the Musicians Union Hall at 124 W. Taylor Street. It was governed by a five-member Board of Directors, a three-member Credit Committee which approved loans, and a Supervisory Committee which conducted audits. The Board of Directors met monthly; stockholders (members) met yearly.

Although the CU initially flourished and declared dividends in 1966, the Board was already concerned by the high number of delinquent loans, over 18%. By March of that year the CU had begun borrowing money from other credit unions; by August they were unable to issue new loans due to lack of funds.

In 1968 the CU members voted to voluntarily liquidate. The situation was precipitated by a musicians' strike in March and April which resulted in members' inability to make loan payments and in high shares withdrawal. When requests for withdrawals reduced the balance of shares on deposit below the legal limit set by the Federal Credit Bureau, the CU had no choice but to liquidate.

Merle Snider, President of Local 368 was appointed Liquidating Agent. Four share repayments were made to members as loans were repaid; final liquidation occurred June 30, 1973 and resulted in members receiving a total of 97% of their share balances.

The records in this series consist of the administrative files of the RMFCU; with few exceptions the financial records of CU members were retained by Local 368. Included here are minutes of and reports to the CU Board of Directors and shareholders, financial and statistical reports, correspondence, copies of liquidation notices sent to members, notes and progress reports on delinquent loan collection and liquidation, insurance/bond policies, bylaws of the Nevada Credit Union League, Inc., and a copy of the 1963-64 Federal Credit Union Act. The files are arranged in order of importance and chronologically within such records as minutes and correspondence. Series 6. Stewards' Reports. ca 1964-1981. 18 cu. ft.

According to Article III, Section 1E of the consitution and bylaws of Local 368, effective January 1, 1964 all members were required to pay the Union 2% of the minimum wage scale earned on any engagement. To facilitate this requirement, all leaders (band, orchestra, group, etc.) filed stewards' reports within 48 hours of the end of the engagement or work week. The reports included time, place, and nature of engagement; names of members performing: their salary or basic scale; and total work dues owed. Traveling members of other unions were also required to pay work dues for engagements within Local 368's jurisdiction.

The stewards' reports are divided into three sections, each arranged alphabetically by name of performer within the section: local members/musicians, ca 1964-1981; non-local/traveling union members, 1980; and non-local, 1981. Stewards' reports for individual performers who were local were usually combined into a single folder unless too bulky to be accommodated in one; non-local reports for individual performers were filed in separate folders by name of performer and date of local engagement.
